The International Solidarity Organization for Palestinian Prisoners (TADAMON) has warned that the Israeli regime's withholding of information about the whereabouts, legal status, health conditions and deaths of Palestinian detainees deprives prisoners and their families of their fundamental rights.
In a report released to mark the International Day for Universal Access to Information on September 28, TADAMON said concealing essential information about detained Palestinians obstructs legal challenges, delays medical treatment, compromises the preservation of evidence and hinders investigations into possible violations.
The organization stressed that authorities holding detainees should promptly disclose information regarding the location of detention, the authority responsible for holding the detainee, the legal basis for the detention, judicial status, health condition and any transfers between detention facilities or medical institutions.
According to the report, when the location of a detainee and his or her legal status remain unknown, families and lawyers face significant obstacles in challenging the legality of the detention or securing legal representation.
TADAMON also warned that withholding medical information may delay urgent healthcare and prevent detainees from receiving appropriate treatment, placing their lives and well-being at greater risk.
The organization said timely access to such information is essential for ensuring detainees' legal safeguards and protecting their fundamental rights under international law.
The report noted that the consequences of withholding information become even more serious when detainees die in custody.
It stressed that information concerning the place and cause of death, medical examinations, investigation findings, the location of the body and procedures for returning the remains to the family is essential for establishing the circumstances surrounding the death.
According to TADAMON, delaying or withholding such information can result in the loss of evidence, undermine accountability and obstruct independent investigations into possible violations.
The organization emphasized that families must not be deprived of their right to know the fate of their relatives or their ability to pursue available legal remedies.
TADAMON said that announcing the death of a detainee does not absolve the detaining authorities of their obligation to disclose the circumstances surrounding the death.
The report called for the proper registration of detainees' places of detention and legal status, the timely provision of necessary medical information, the immediate notification of families in the event of a detainee's death, and the preservation of all relevant records and evidence.
The organization concluded that protecting detainees extends beyond the conditions of their detention. It said ensuring that detainees and their families have timely access to essential information regarding their whereabouts, legal status and fate is an integral part of legal and humanitarian protection.
